2. Application

These Terms & Conditions apply to purchases made through bykrisman.com by consumers.

Before placing an order, customers must be given the opportunity to read and save these terms. Any mandatory consumer rights under applicable law take precedence over conflicting provisions.

3. Our collection

KRISMAN specialises in antiques, art, vintage pieces and decorative objects. Most pieces are pre-owned and individually selected.

We aim to describe each object accurately, including its materials, dimensions, age, condition and any known defects.

Age-related wear, patina, variations and previous repairs may form part of an object’s character. Material characteristics or defects that are relevant to the purchase will be described as clearly as possible.

Attributions, dates and origins may sometimes be based on research rather than definitive documentation. Where uncertainty exists, we will indicate this.

Product photographs show the actual object offered unless clearly stated otherwise. Digitally created interior visualisations, where used, are supplementary and do not replace original product photographs.

4. Prices and availability

All consumer prices are shown in euros and include applicable taxes.

Where the VAT margin scheme applies, VAT is included in the selling price but is not separately itemised on the customer invoice.

Complimentary shipping within the Netherlands is included for items eligible for standard parcel delivery.

For larger or particularly delicate items, specialist delivery is quoted individually. The delivery charge and the estimated direct return cost will be communicated before purchase, and the delivery arrangement must be agreed before the customer is bound by an order.

Most objects are one of a kind. Availability is therefore limited and subject to confirmation. If an object is unexpectedly unavailable after an order has been placed, KRISMAN will contact the customer and arrange an appropriate refund.

5. Ordering and payment

An order is placed through the checkout process and confirmed electronically.

Available payment methods and any relevant conditions are shown before the order is submitted.

KRISMAN will offer payment arrangements that comply with Dutch consumer rules concerning advance payment. Customers will not be required to pay more than the legally permitted advance amount unless they voluntarily agree to do so.

Payment processing may be provided by an external payment service provider.

We reserve the right to contact customers if information required to fulfil an order is incomplete or inaccurate.

6. Delivery

We currently deliver to addresses in the Netherlands.

Parcel-eligible objects are shipped without an additional delivery charge. Larger or more fragile objects may require specialist transport.

Delivery arrangements and expected timeframes are communicated before purchase. Unless a different delivery period has been agreed, delivery will take place within 30 days of the agreement.

KRISMAN is responsible for the goods during transport until delivery to the customer or a person designated by the customer, subject to applicable legal exceptions.

Customers are encouraged to inspect the parcel upon arrival and to report transport damage promptly. Such a request does not limit statutory consumer rights.

7. Right of withdrawal

Consumers generally have the right to withdraw from an online purchase within 14 days after receiving the goods, without providing a reason.

Customers may exercise this right by using the withdrawal facility on our website, by emailing info@bykrisman.com, or by sending another clear statement of withdrawal.

Once withdrawal has been communicated, the customer must return or hand over the goods without undue delay and no later than 14 days afterwards, unless KRISMAN has agreed to collect them.

The customer is responsible for direct return costs where this has been communicated before purchase. For goods that cannot normally be returned by post, an appropriate return-cost estimate will be provided before the order is placed.

KRISMAN will refund all payments due under the statutory withdrawal rules, including the cost of standard outward delivery where applicable, within 14 days of being informed of the withdrawal. We may withhold reimbursement until the goods have been received or the customer has supplied evidence of having returned them, whichever occurs first.

Refunds will normally be made using the original payment method unless expressly agreed otherwise, without additional refund fees.

Customers may be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal also generally applies to antique, vintage, second-hand and one-of-a-kind objects. Any statutory exception will be explained before purchase where relevant.

8. Returns and fragile objects

Please use suitable packaging when returning an object.

For furniture, large mirrors and particularly fragile objects, KRISMAN can help coordinate specialist return transport. This service does not restrict the customer’s right to withdraw.

Where KRISMAN arranges collection, the applicable arrangements and responsibility for transport will be confirmed in writing.

Further details are provided in our Shipping & Returns policy.

9. Statutory consumer rights

All goods are covered by the statutory rights that apply under Dutch consumer law.

The nature, age, condition, price, description and disclosed defects of a pre-owned object may affect what a customer can reasonably expect.

Nothing in these terms excludes the customer’s legal rights where goods are defective, misdescribed or otherwise fail to conform to the sales agreement.

Where a problem falls under statutory conformity rights, KRISMAN will provide an appropriate solution without charging costs that the law requires us to bear.

10. Complaints

Questions or complaints may be sent to info@bykrisman.com.

Please include the order number and a description of the issue, together with photographs where helpful.

We will acknowledge complaints and work towards a fair solution within a reasonable period.

Customers retain their statutory rights to seek further remedies or bring proceedings before a competent court.

11. Intellectual property

Unless otherwise stated, the website’s written content, branding and original photography belong to KRISMAN or are used with permission.

Unauthorised commercial reproduction is not permitted, subject to applicable legal exceptions.

12. Liability

KRISMAN remains responsible for obligations arising under applicable consumer law.

Nothing in these terms excludes liability where exclusion would be unlawful, including liability arising from intentional misconduct or other mandatory legal provisions.

13. Governing law

These terms are governed by Dutch law.

Customers retain the protection of mandatory consumer laws applicable to them. Any dispute will be brought before a competent court in accordance with the applicable jurisdiction rules.

14. Changes

We may update these terms from time to time. The version made available to the customer when entering into the agreement will apply to that purchase, subject to mandatory law.
